Rules and Regulations for Common Dock Facility

WHEREAS, Article II Section 2.3 (a)(ii) provides for a community dock as a common property:

 

WHEREAS, Article II Section 2.3 (b) provides that the Declarant shall have the right to establish rules and

regulations for the use of the dock and related facilities:

 

NOW, THEREFORE, the Declarant establishes the below rules and regulations for the common dock

facility at Bermuda Pointe:

1. All owners shall be permitted to use the common dock facility upon the rules and regulations

described herein and as amended by the Board of Directors of Bermuda Pointe Partnership

Owners Association from time to time.

 

2. All boats must be registered with POA to include description, registration number, and

certificate of insurance.

 

3. There shall be three types of docking at Bermuda Pointe Common Dock Facilities:

 

a. DAY docking on a space available basis. It is the intention that parties shall use the day

docking facility for the purpose of loading and unloading of persons and recreational

equipment.

 

b. OVERNIGHT docking for a period not to exceed forty-eight (48) hours. At the end of forty-eight (48) hours of occupancy, an owner may extend for an additional day or days on a

space available basis. It is the intention that an owner shall only use the overnight docking

facility on an irregular basis and not for storage of their boat.

 

c. LONG TERM to mean a fixed space to be occupied on a monthly, or annual basis.

 

4. A schedule of rates for the use of the docking facility shall be determined annually by the Board

of Directors.

 

5. No boats shall exceed 28 feet in length.

 

6. Dock Master shall have the authority to assign dock space to the overnight and long-term users.

 

7. For the purpose of rules and regulations, the DAY docking function shall be on the outside Skull

Creek side of the dock (face dock), and the LONG-TERM docking shall be on the inside.

 

8. Owners shall comply with all Coast Guard, State of South Carolina, County of Beaufort, and

Town of Hilton Head Island rules and regulation applying to boaters, boating, boating

equipment, and boat safety.

 

9. Any boat using the docking facility must first be registered with Atlantic States Management.

 

10. Face dock is reserved for day boaters and overnight docking.

 

11. Overnight docking is on the honor system and payment is to be remitted to ASM at the end of

each month. Rate for overnight docking is $10.00 per night.

12. Only boats registered to the dock holder can occupy their assigned dock.

 

13. Boats on the end slips should tie up with the bow out as far as practical to help with space.

 

14. Dock rentals are made to individual property owners and are not transferrable.
